Terms of Service

LAST UPDATED: December 15, 2025

1. Acceptance of Terms

By accessing or using ArcTen's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Note for Enterprise Customers: If you have entered into a separate Master Services Agreement (MSA) or Statement of Work (SOW) with ArcTen, the terms of that agreement shall control in the event of any conflict with these public Terms.

2. Description of Services

ArcTen provides enterprise intelligence deployment services, including forward-deployed engineering, sovereign AI system architecture, and custom ontology construction. Our Services are designed for institutional customers and require appropriate technical infrastructure (VPC, On-Premise, or Private Cloud).

3. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and proprietary algorithms, are owned by ArcTen or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5. Data Sovereignty & Model Training

Sovereignty: ArcTen adheres to a strict data sovereignty architecture. Unless explicitly authorized in a separate Statement of Work (SOW), proprietary data processed within a deployed environment (VPC or On-Premise) remains the sole property of the Customer.

No Training on Customer Data: ArcTen does not use Customer Data to train, fine-tune, or improve its foundational models for the benefit of other customers or third parties.

6. Limitation of Liability

To the maximum extent permitted by law, ArcTen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

7. Modifications to Terms

ArcTen reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

We respect your privacy. We collect only the information necessary to provide our Services, such as contact information when you request a deployment or technical logs required for system stability. We do not sell your personal data. For our full Data Processing Addendum (DPA), please contact our legal team directly.
